These terms govern the use of our website and the services provided by Metal & Flake. By requesting a quote or engaging us to carry out work, you agree to these terms. A few bracketed details (deposit, payment and quote-validity terms) still need completing, and the document should be reviewed before publishing.

1. About these terms

This website is operated by Metal & Flake ("we", "us", "our"). By accessing this website or engaging our services you agree to be bound by these Terms & Conditions and our Privacy Policy.

2. Quotes

All quotes are provided free of charge and without obligation. A quote is based on the condition of the concrete slab and the scope of work as assessed from the information you provide. Quotes are valid for [30] days unless stated otherwise. If the slab condition differs materially from what was assessed (for example, hidden moisture, structural cracking or contamination found during preparation), we will discuss any variation in scope and price with you before proceeding.

3. Bookings, deposits and payment

  • A deposit of [deposit %/amount] is payable on acceptance of a quote to secure your booking and order materials.
  • The balance is payable on completion of the work, unless other terms are agreed in writing.
  • We accept [payment methods].
  • Deposits are refundable up to [X] business days before the scheduled start date, less any non-recoverable costs already incurred (such as custom-ordered materials).

4. Your responsibilities

To allow us to complete the work safely and on schedule, you agree to:

  • Fully clear the work area of all vehicles, belongings and stored items before the scheduled start date
  • Provide safe access to the site and to power and water as required
  • Disclose any known issues with the slab, drainage or moisture
  • Keep the area clear of foot and vehicle traffic during the cure period as advised at handover

5. Preparation and existing conditions

Concrete is a natural material and existing slabs vary. While we test and prepare every slab to a professional standard, we cannot guarantee against issues arising from pre-existing defects that were not reasonably detectable at the time of quoting, such as hidden moisture ingress, hydrostatic pressure, or undisclosed prior coatings. Where such issues are found, we will advise you before continuing.

6. Cure times and use

Epoxy and polyurethane systems require time to cure. We will advise you of the specific times before you can apply foot traffic and vehicle traffic to your floor. Using the floor before the advised cure times may damage it and is not covered by warranty.

7. Warranty

Our installations are covered by a written 7-year guarantee and warranty on materials and workmanship, the full terms of which are provided to you on completion. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

8. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a remedy as provided by that law. These terms operate subject to those rights.

9. Liability

To the extent permitted by law, and except for liability that cannot be excluded under the Australian Consumer Law, our total liability arising from the supply of goods or services is limited, at our option, to re-supplying the services or paying the cost of having the services re-supplied. We are not liable for indirect or consequential loss.

10. Website use

The content on this website is provided for general information only. We make reasonable efforts to keep it accurate but do not warrant that it is complete or error-free. Images of completed work are examples; results vary with slab condition, colour selection and lighting.

11. Intellectual property

All content on this website — including text, images, logos and design — is owned by or licensed to Metal & Flake and may not be reproduced without our permission.

12. Governing law

These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that jurisdiction.
